A mortgage is a death pledge or a pledge to the death.

I'm guessing to the death of the debt, but in the feudal times if you owed a debt to the Lord, it was forgiven when he died. No "successors and or assigns" back in those days. I imagine that the death of a Lord was followed by widespread celebration since it was almost impossible to be a serf and not owe a debt to the Lord.
