TiVo: Court denies EchoStar's motions

SAN FRANCISCO (MarketWatch) --TiVo said Wednesday evening that its patent infringement case against EchoStar Communications will proceed in a Texas federal court\.
TiVo Inc. (TIVO), which makes digital video recorders, said a U.S. District judge in the Eastern District of Texas, Marshall Division, denied EchoStar (DISH) motions to dismiss the case or move it outside Texas. EchoStar is based in Englewood, Colo.
Alviso, Calif.-based Tivo claims EchoStar is violating its "Time Warp" patent, which allows DVR users to pause live broadcasts and show instant replays, among other features.
Jury selection in the case is scheduled to begin on Oct. 4, the TiVo said.
Shares of TiVo fell 2 cents to close at $4.16 ahead of the announcement.
Shares of EchoStar were unchanged at $30.59. |
