If your mom's name is still on the mortgage I am not sure if he can borrow without her signature.

Unless you get crystal clear advice here (and perhaps even if you do) your mom should be on the phone with an attorney to discuss this is she is on that mortgage. Otherwise I doubt it can possibly matter.

Unless she is on that mortgage there is no way to pass the debts on to someone else. This I am pretty certain of that regardless of anything else. Certainly if he dies it might come out of the estate and legal bickering might chew up 100% of the estate but his debts can not OBLIGATE you in and of themselves.

Those are my opinions and rules might even vary state by state.
