Whether the law and/or the process occur at the federal or the state level, it's still based on the will of the majority.

Absolutely wrong. One brave judge can tip the balance. One brave judge can make a stand against a nation of hundreds of thousands, and prevail.

Maybe they don't tend to be so brave, maybe they don't tend to have that kind of guts, but they have the power if they choose to wield it.

I would. I don't give a rat's ass about the will of the majority. Let justice be done though the heavens fall.
