Re: proposed new law. We may be talking at cross-purposes because, it seems to me, that you think that Congress (and I) decided in advance that the Florida law was unconstitutional. But Congress isn't the body which decides whether a law is unconstitutional. That's what judges do. (As well as deciding whether a certain individual was given due process and so forth.)

Since we haven't got to a court case yet, I keep stepping back and saying, "not time for that question."

The stage we are at now is whether Congress should give courts the power to make that adjudication. Well, I say, that's what Congress is supposed to do, inter alia, pass laws that allow courts to do what courts do.

Then let the process go forward.

I'll develop an opinion once I see the law, and if there is a case, once I see the briefs, which are generally posed on Findlaw.
