Steve, it's simple. Liberal views on states' rights changes with the wind, but their view of judicial activism doesn't.

- Florida court orders additional recounts to help Gore win? States' rights.

- Supreme Court bans executing of murderers under the age of 18? Federalism.

- Florida court orders the starvation of an invalid? States' rights.

- Supreme Court legalizes abortion based on "unreasonable search and seizure"? Federalism.

- California and Massachusettes courts forcing the legalization of gay marriage based on "equal protection"? States' rights.

No wonder they're fighting tooth-n-nail against Bush's judicial appointees. As long as some judge validates a "liberal" interpretation of the law, they still have influence over society.
