Congress can't order a new trial, as they don't have standing. Also, that would violate separation of powers. Congress gave the parents the right to ask for a new trial. The parents have not yet asked for a new trial. They filed a motion for emergency injunction, complaining about things that happened at the trial court level. news.findlaw.com I assume we both agree that the judge can only rule on what's put before him. That ruling: news.findlaw.com I don't get the impression that these lawyers really have their act together, and unfortunately for Terri, she doesn't have time for them to get their act together.
