Punitive damages can vary widely. The jury has wide sway in awarding an amount which they feel properly represents the malicious, intentionally egrigious conduct of the defendent. It is possible to read a punitive damage award of this size as a minor victory for Toshiba (if millions of dollars can ever be considered a victory). The jury seemed to believe that Lexar's rights had been violated, hence the original compensatory award, but that the conduct of Toshiba was not terribly, terribly malicious. This may reflect the challenges of regular people on a jury dealing with the intricacies of patent and intellectual property law....
