Wisconsin State Statute 7.51(5)(b) states that “the municipal clerk shall deliver the ballots, statements, tally sheets, lists, and envelopes for his or her municipality relating to any county, technical college district, state, or national election to the county clerk by 2 p.m. on the day following each such election. Wisconsin State Statute 7.60(3) goes on further to say “if returns have not been received from any election district or ward in the county, they shall dispatch a messenger and the person having them shall deliver the returns to the messenger.”

Information provided to our committee suggests that the City of Milwaukee has yet, in March of 2005, some five months after the election, to comply with the specific timeline requirements detailed in state statutes,” Senator Leibham said. “In addition, it seems as if the Milwaukee County Election Canvassing Board certified their county election results without having received the appropriate information from the City of Milwaukee – their largest municipality. This is a clear violation of state law.”

Senator Leibham expressed further concern regarding the fact that the State Elections Board used this incomplete information from Milwaukee County when they certified our statewide election results.

“If found to be true, Wisconsin’s overall certified election results are in serious question and most likely invalid,” concluded Senator Leibham.
