Admittedly, it must be very rare for spouses who are all-but-married to someone else not to go ahead and get a divorce and let the family deal with the incapacitated person.


You spoke to a law for "life or death decisions for an incapacitated person(s)." I read that as universal applicability. If, instead, you write your law specifying only long-term cases with spouses who hook up with someone else after a number of years giving the appearance of a conflict of interest, I withdraw my objection. <g>

For the class of incapacitated persons, it's not practicable.
