I love the part where companies are "by law" supposed to include "going concern" notices in their filings (and, given we're talking Safe Harbor, I presume their press releases as well). As for why Patch included that sentence in the paragraph about fundamentals, perhaps he was trying to say that when demand goes down the law requires companies to issue a PR with a going concern clause. ;^)
