LITIGATION UPDATE: CIRCUIT COURT OF VIRGINIA
Yesterday, in response to a letter I sent them last week, demanding the liens be removed, which I sent in accordance with the bench and written orders of the Circuit Court, defendant the Virginia Department of Taxation sent me a release of Memorandum Lien. That means that the Virginia Department of Taxation, after three years of harassment, defamation and attempted asset seizures all over the country, now all of a sudden decides I don't owe $1.7 million in taxes, after all. The Release is not based on new information; the Tax Commissioner and the Department have had information I provided them, including trade records and three affidavits sworn out under penalty of perjury in state and federal court that I never owed them a cent, for now going on two years. Remember: they tried on 2/25/05 to have the Circuit Court order me to post a $1.7 million bond or forfeit any right to be heard in that Court. They tried their luck, but were summarily denied by the Court in no uncertain terms. And now they do a complete about-face.
The Release is dated 3/25/05, which means they acted within 24 hours of receiving my protest letter and demand they revoke the liens. Now why did they wait all this time, get hit with adverse rulings, and only then take action?
Moreover, they have serious problems now, because on 3/4/04 the Assistant Attorney General told me - in writing I have recorded - that there were no judgments in the Circuit Courts, and now it turns out that in fact there was one on 6/17/02. Final problem: the Notice of Intent to File a Memorandum of Lien - required before they can go to Court, have to give citizens notice and opportunity to challenge your credit record being destroyed through court orders - well, they sent it to me on August 6, 2003. That's right, a full year after the Court order was already entered. Nice work.
Berber and Moor, when calling me a "menace to the judicial system," claimed in Texas federal court that I sued VA "merely because the state is trying to collect taxes" from me. Doesn't seem that way now does it. Now, not just defendants the Tax Commissioner, the Virginia Department of Taxation and all other officers and employees involved, but also the Office of the Attorney General owe me and the Courts one Hell of an explanation - plus substantial damages.
This is the first major victory in quite some time. Those of you ever in this position - and I hope this never happens to any of you - I hope you'll see that when you're on the receiving end of this kind of garbage, persistence pays off, there is justice to be had in this country if you remain committed. But, we're not nearly done. Lengthy explanations for all of this, damages - and, you better believe it, I am going to demand that all parties responsible for what happened are criminally indicted. I have a long memory. I am not the slightest bit forgiving of people using public agencies to try to ruin their litigation adversaries. Southwest Securities, you're on notice that when I find out exactly what you and your corrupt cronies did, you're going to get the book thrown at you. Count on it, amigos - the sorry lot of you. Oh yes. Your laughing days are coming to an end. Have a very nice day.
