You must be too young to remember when Eisenhower put the Arkansas National Guard under federal control and sent in the 101st Airborne to enforce Brown vs. Board of Education. Unconstitutional? eagleton.rutgers.edu If Jeb Bush decided to use state troops in order to enforce Brown v. Board of Education himself against a state school in Pinellas County, would that have been unconstitutional? What if a Pinellas County judge told him that he couldn't do it? Should he have listened? How does it differ in any way if Jeb Bush decided to enforce obedience to Congress rather than the SCOTUS?
