Ok, but:

3. Isn't going after the incentive, it's enforcement, and ineffective (as the current situation proves).
4. Ridiculous and expensive. Remember, without the incentive, they will not come.
5. Very good. There is labor demand and labor supply. You need to manage it to provide mutual benefit. But first to have to stop the US employers that will break any prospective system, to save a buck.

As usual, ideology gets in the way of a pragmatic solution. Who said "the business of America is business"? And the "art" of this particular business is mutual benefit, not greed.

We need them, they need us. Accept that and we're on our way to a compromise solution that is mutually beneficial. Mire it in politics and the problem lasts forever.
