I understand your position from past readings. My question/point was that, from a practical "self-preservation" point of view, they had to plead immunity under the proposition that none of those mitigating factors have occurred. All the more so since there has been no finding to that effect. It would appear that the court will have to rule that at least one of those factors have occurred, or rule that none of them occurred prior to ruling on the immunity pleading.
