so where in the constitution does it say the judicial branch creates the laws of the land? Article 3 of the constitution says you are dead wrong... The Constitution doesn't say they create law because the legislature creates the laws of the land. However, the court's interpretation of a law or their application of the Constitution to a particular situation can prompt the creation of a new law through the legislature.
