In November 2004, voters returned President George W. Bush to office for a second term. They also expanded the Republican majority in the U.S. Senate while South Dakota voters defeated Senate Minority Leader Tom Daschle, in large measure because of his leading role in blocking President Bush’s judicial nominees. With Senator Harry Reid (D-NV) now leading the minority, many hope that the partisan obstruction of judicial nominees that plagued the 108th Congress will be diminished.

Nevertheless, with the likelihood of a Supreme Court vacancy, the judicial confirmation process in the 109th Congress promises to remain contentious as some Senators continue to vow to employ unprecedented techniques to block confirmation of several nominees.
