That wasn't a fillibuster. That was real debate on an individual with some serious ethics problems. The debate only lasted a few days. This guy later had to resign from the court. The up down vote was not going to be denied, but before they could vote Johnson withdrew him, not because of un-ending debate and Sen. Byrd reading from a Children's book, but because Fortas didn't have the votes in an up-down vote of the whole Senate. This however isn't the case with Bush nominees. These respected judges HAVE the votes necessary, which is something Fortas never had.
