Fortas was ALREADY on the court. Thats a HUGE difference. Another HUGE difference is that Fortas NEVER had the votes even if it went to the whole Senate. Not only that Fortas was then forced to RESIGN from the court in disgrace. The Republicans were absolutely right about Fortas.
