It certainly was the intent of the framers to have three separate branches of government, with checks and balances.

When we slip into one party rule, we erode the effectiveness of these checks and balances. When the congress, the executive branch and now by proposed elimination of the fillibuster in judicial nominations we have in effect a defacto republican judiciary.

Since the Judiciary is such a fundamental part of our government, in framing the laws of the country, it's important that the courts represent all of the people in the country. The fillibuster is a defacto screen that keeps judges from being too liberal or too conservative, and that restriction has kept the judiciary more main stream on the whole. And that is good for the country.

IMHO we could get past this focus on eliminating the fillibuster...and simply move to a straight up or down vote for judicial nominees...but lets make the requirement of that vote a super majority...the 60 votes required for cloture...would make a good model for an up or down vote. Even a 2/3 majority should be considered.

We need the judiciary to straddle the middle, because if it strays too far in either direction it will be bad for the nation.
