I don't like the idea of an employer sticking his nose into people's private business, especially with something legal like cigarettes. But, I doubt the employees would have any legal recourse. He's not descriminating based on any known descrimination statute. He has a right to set workplace rules. Companies are essentially dictatorships. Smoking can affect employee performance, like sick days, and long term health. It can push up his health insurance costs.

I'd like to see someone challenge his policy, as it seems unfair, but I doubt they will win.
