Yes, I'm serious. Remember, I agree with you on this one Brian. I think it's going to far for an employee to fire someone for doing something legal outside of the workplace. So, we're not arguing about whether the person should be fired or not. I don't think they should.

But, the courts have to deal with much larger legal issues that must be considered. There are issues of employers rights to set workplace rules, especially in "at will" employment states. The courts might decide that the employers right to set workplace rules superceed the employees right to privacy. We shall see. I hope the employer loses, but they have a lot of power in our society.

I don't think this case is unprecedented. Which is probably why the employer made this rule, as the courts have already sided with the employers on this issue.
