That would by definition not be warning shots.

Why do you think the driver ignored the waving arms? Not to mention the pattern of lights

I think he was nervous (as were the soldiers) and he was driving fast, probably with some reason as the road is dangerous. Driving fast increased the risk from checkpoints but probably reduced other risks.

Nonsense. The Americans are more careful then most when they are fighting a war. Of course they also have more firepower than anyone else and have been involved in more violent and potentially violent situations that most developed countries. And of course if the Americans do shoot or bomb the wrong person it gets a lot more press than it does when many other countries do the same thing.

I read that it was raining too which would have made seeing a patrol difficult, even if they did have waving hands. Maybe they looked like somebody catching a taxi on a wet night.

It would have probably made it harder, but I don't think it was just a handful of soldiers stumbling around in the rain. I think it was a bit more visible than that.
