Frist should submit the rule change for an up or down vote. Simple majority is all that's required.

I lost a lengthy draft response, when Firefox crashed on me. In retrospect perhaps it was best. It's occured to me that I think differently about the Constitution and what is or is not un-Constitutional than the typical conservative that inhabits these threads.

I thought the line-item veto was blatantly unconstitutional. Conservatives thought is was fine.

I thought the late-term abortion bill was obviously unconstitutional. Conservatives thought it was fine.

I thought the McCain-Feingold was Constitutional. Conservatives thought is was un-Constitutional.

I thought that using FDA regulations to obstruct the will of the people in Oregon was un-Constitutional; conservatives thought it was Constitutional.

I think that the filibuster rule is Constitutional. If the Senate wants to change the rule, go for it. It takes a simple majority to make the change. If there's a single member of the Senate, he/she can challenge it through the Federal Courts. I believe that such a challenge will rise quickly to the USSC for resolution. It did when a few members challenged the line-item veto.
