I saw the founding fathers actually dividing power among 4 or 5 branches of govt, the fourth being the States and the fifth being the People. Unfortunately the powers of the States and People are continually being watered down. States can't seceed. States are denied Transportation or Education funds if they don't go along. The people are denied their full rights in the Bill of Rights, especially in the infringement of the right to keep and bear arms--the People's right--and the People's greatest power. Look at all the exceptions to whats constitutionally protected from unreasonable searches and seizures, especially with regards automobiles or the right to freely exercise religion wherever you want, or free speech such as the Mc Cain Feingold finance reform act. There is a current check on fillibustering and that is the labal of obstructionism, which is quite powerful when the fillibusters are reported as such. Thats why the Schumer's of the world have to pick their battles carefully, at least some Senators have to, where their voters are offended.
