Ted, That's why we have laws that clearly define who is protected under equal protection.

You've got this backwards. There is no law clearly defining who or what is protected under equal protection. The MA Supreme Court just told the legislature to write such a new law, and the federal judge just assumed that the 14th amendment also extends to gay marriage without citing any law defining it that way.
