Haven't gotten to the CC yet. But the miss could be high R&D for the IVIS 3D system. Anyhow, I have further thoughts on the litigation here:

The animal model itself, (not the imaging, not luminescence) is fairly important to XGEN's business, and AntiCancer does have older IP in terms of generating animal models of metastatic cancer. This is probably the bone of contention. XGEN really needs to resolve this via cross-license if reasonable terms can be had. Otherwise the legal cloud will negatively impact terms of next financing. As a Wave II IPO that had to revise to a smaller debut, they need another financing unless sales continue to blow out analyst estimates. Not something I like to bet on. Looking to nibble here, as a legal deal will help the share price a lot, but odds? 2:3 is my guess.
