I'm not sure about Saddam being held by the Iraqis, Ish. I found this statement in that Sun article I posted. There are lots of Ba'athists still left in Iraq. They are a major part of the insurgency. It seems unlikely that we are so confident about our newly trained Iraqi police and troops that we would entrust Saddam to them:

Saddam Hussein is being held by US troops at an undisclosed location in Iraq as he awaits trial on numerous charges, including murdering rivals, gassing Iraqi Kurds and using violence to suppress uprisings.
