Re Saddam in his undies pic - a question :

I am assuming, and therefore seeking clarification, that Saddam is no longer an "Enemy POW", because Iraq has a sovereign government and he is Iraq's prisoner ? If the assumption is true, the Geneva Conventions dont apply to him.
