Conservatives, esp. "constitutional conservatives", have had things move against them for a long time. Even when Reagan one by a landslide and used terms they like they didn't really get movement in their direction, just maybe a slowdown or temporary halt of the move against them. Finally they look like they might have real power...

Don't let it break your heart, Tim. You won't get what you wish for regardless. It would take activist reactionaries to undo the major trends, not constitutional conservatives. The best we're going to get would be some differential rulings on property rights and interstate commerce. The social conservatives are in for an even bigger let-down.

I don't think it should require 60% to get any movement on what the minority refuses to accept

We have developed a very strange sense of proportion. We call winning 55 percent of the vote a landslide, for heaven's sake. I might consider using that term as we approach 80 percent. At 55 percent, 45 percent of us feel disenfranchised. And this is a good thing, how?

Think of it this way. If we didn't have so much hostility and polarization, there would be no problem getting sixty percent of the vote for a nominee. The opposition is united because they are under siege. Otherwise, they could be picked off in sufficient numbers that a filibuster would be moot.
