Still its not unreasonable to say it wasn't a landslide

I wasn't addressing this or any other election, merely trying to establish some sense of proportion around your point about passing bills with or without filibuster. Anything that 51 percent or even 60 percent of citizens want to do still leaves a lot of people out in the cold. Now, if forty percent of the people are just mildly displeased, no big deal. But if they're really opposed to it, I don't think it should be done even though legally it can be. We're all in this together and we can't treat each other that way. This dog eat dog stuff demeans us as humans and as Americans.

Perhaps we disagree on the meaning of the term judicial activist.


Judges respect precedent and so do I. Not that precedent should never be upended, but I think caution is called for. So, yes, I guess we disagree. I think that activism subsumes the overturning of firmly established precedent. We can't go back now and say, whoops, we were mistaken, for example, that the bill of rights applies to the states.
