Slavery is a special case because conflicts over slavery and compromises over slavery were part and parcel of the Foundation. It's hard for us to comprehend that at this far remove, but after the American Revolution, if slavery hadn't been legalized, there would have been no America as we know it. Two Americas, at least, if not more.

Thus, it took another dreadful war, which disenfranchised the Southern states, so that they couldn't vote on the 13th and 14th Amendments, to end slavery.

Any modern day judge who thinks she could have abolished slavery by judicial fiat is a moron.
