They should have not written anything down.

A handshake among getlemen would have been enough.

I know, I know this is not very lawyerly, but special rules apply to the Senate.

Having written the deal down, there will be plenty of idiots who will try to pick it apart comma by comma, phrase by phrase.

Its the spirit of the thing that matters, and the spirit could have been captured in a handshake.

The reason why the deal is so badly written is that the Senators are used to doing things informally, on the basis of handshakes and nods.
