"Tradition" ain't RULES. (If it was, it would have been written down and adopted as the rules for the institution.)

The STATUS QUO (rules of the Senate) says cloture requires a 2/3 majority vote to shut off debate.

The STATUS QUO (rules of the Senate) also say that it requires a 3/5 majority vote to CHANGE THE RULES OF THE SENATE.

(And, I don't recall anything in the rules that say filibusters can't be waged against judicial nominations --- or anything else a Senator wants to slow down. I understand that Senator Brownback wants to fillibuster the Stem Cell Bill in the Senate... because it CLEARLY has overwhelming support there, and that's the only way that he --- as a minority --- can slow it down. So what? That's allowed by the rules. ...until 60 Senators vote to shut down his fillibuster.)

If you want to CHANGE THE RULES (change the Status Quo), then fine: change 'em.

But don't try to IGNORE the rules, and make 'em up out of thin air as you go along.... That's just silly.
