If one accepts the givens and self-imposed constraints of your recent posts, any discussion is next to impossible.

One can, however, question the validity of this statement:

With the "conservative" Congress threatening to impeach judges they don't like, this doesn't seem likely in the near future.

The average judge knows such threats are idle. The votes necessary to impeach probably aren't there, the votes necessary to convict definitely aren't there, and the American public would undoubtedly react quite negatively at the ballot box to such a naked power-play . If Franklin Roosevelt could not pack the Supreme Court at the pinnacle of his overwhelming popularity and political power, these guys aren't going to get anywhere with such threats today.
