I am constantly spammed by this person (see header below). Reporting the spam to the ISP postmas...@gt.ca, a...@gt.ca results in an auto ignore saying one of their abuse representatives will contact me within an hour, yet I never hear back. Even tried unsubscribing on the off chance someone signed me up for the spam since the ISP doesn't do anything about it. This has been going on for months. Any tips on what I can do?

Our customers have been seeing some of this spam as well. I called gt.ca this afternoon and was requested to send my complaint to helpd...@gt.ca if I had not received a call from their abuse desk. I'm waiting...

Investment Banker and Associates Charged In Stock Fraud Scheme ROSLYNN R. MAUSKOPF, United States Attorney for the Eastern District of New York, and PASQUALE J. D'AMURO, Assistant Director-in-Charge, Federal Bureau of Investigation, New York, today announced the unsealing of an indictment charging DANIEL RUBIN of Lake Helen, Florida, DANIEL NOURANI of Los Angeles, California, GLEN SANTHA of Lake Helen, Florida, and SCOTT HALPERIN of Manalapan, New Jersey, with conspiracy to defraud the investors of several publicly held companies. (1)
The defendants are scheduled to appear for arraignments this afternoon before United States Chief Magistrate Judge Joan M. Azrack at the U.S. Courthouse, 225 Cadman Plaza East, Brooklyn, New York. The investigation resulting in the defendants' arrests was conducted with the assistance of the United States Securities and Exchange Commission, which previously instituted public administrative and cease-and-desist proceedings against RUBIN and HALPERIN in connection with the stock fraud schemes.
THE 1-800-ATTORNEY SCHEME
According to the indictment, RUBIN, the chief executive officer of Rubin Investment Group, an investment bank with offices in Los Angeles, California, Manhattan and Lake Helen, Florida, defrauded the shareholders of 1-800-Attorney, Inc. ("1-800-Attorney"), a public company which operated an attorney referral service located in Lake Helen, Florida. In October 2002, RUBIN induced the company to make him its chief executive officer and to issue him approximately 3.2 million shares in return for his promise to invest over $1.2 million in capital in the company. However, RUBIN failed to make the investment, and shortly after assuming the chief executive officer position, he purchased on the open market additional 1-800-Attorney stock (which traded at the time on the NASDAQ Small Cap Market). Through various fraudulent and manipulative practices, RUBIN engaged in a scheme that drove up the stock price from roughly $.70 to over $7.00 by early December 2002, an increase of over 1,000% . RUBIN then sold off a substantial portion of his stock at the artificially inflated prices. Thereafter, the stock price steadily declined to less than $.30 per share by March 2003, when the stock's SEC registration was terminated, and the stock was moved to the Pink Sheets, a listing service for small cap stocks.
THE STOCK PURCHASE SCHEME
The indictment also charges that in approximately October, 2002, RUBIN set up a team of "cold callers"at the Lake Helen office and instructed them to contact small-cap companies and induce the companies, or one of their large shareholders, to sell the Rubin Investment Group large blocks of their companies' stock, at discounted prices. The sales pitch contained a number of misrepresentations. For example, the cold callers stated that the Rubin Investment Group managed an investment fund with 3,000 doctors and dentists as investors, when in fact the fund consisted of a few investors with nominal investments. Similarly, the small cap companies were told that the Rubin Investment Group had a large base of brokers who promoted stocks to the firm's clients, when in fact the firm had no brokers. NOURANI, the managing director of Rubin Investment Group in Los Angeles, and SANTHA, the firm's director of investment banking, allegedly created scripts for, and trained, the cold callers, and personally made misrepresentations to the small cap companies and their shareholders.
The indictment alleges that after acquiring blocks of small cap stocks, RUBIN engaged in fraudulent and manipulative practices to artificially increase the stock prices. For example, in July 2003, the Rubin Investment Group acquired a large block of stock from Augrid Corporation, whose stock traded on the over the Over the Counter Bulletin Board market, refused to pay the company the promised consideration, and then pressured the company to accept $1 million less than negotiated purchase price. Thereafter, on September 10, 2003, RUBIN traded over 100 million of the Augrid shares from one brokerage account he controlled to another of his accounts (commonly referred to as a "wash sale"), to create the false impression of genuine market interest in a stock. As a result, the stock price increased over 40%, and RUBIN then sold a substantial portion of his Augrid stock on the open market at the artificially inflated prices. In total, the defendants reaped profits of approximately $2.3 million from the Augrid scheme.
THE CLASSICA AND MARX TOYS SCHEMES
Finally, the indictment alleges that beginning in August 2003, SCOTT HALPERIN and others in the Rubin Investment Group participated in fraudulent schemes involving the stocks of The Classica Group, Inc., a manufacturer of pasteurization and sterilization equipment headquartered in Sayreville, New Jersey, and Marx Toys & Entertainment Corporation, a toy retailer located in New Jersey. At the time, the stocks of both companies traded on the Over the Counter Bulletin Board market. HALPERIN was Classica's chief executive officer and a substantial stockholder of Marx Toys. According to the indictment, HALPERIN issued Classica stock to the Rubin Investment Group at a discount from the market price in exchange for the Rubin Investment Group's agreement to inflate fraudulently the company's stock price. HALPERIN also caused Classica to issue materially false press releases touting the company throughout the summer of 2003, and engaged other stock promoters to disseminate the false information. As a result, by August 27, 2003, Classica's stock price more than doubled, and the Rubin Investment Group proceeded to sell its Classica stock at a profit of over $500,000. The indictment alleges that in late August 2003, HALPERIN engineered a virtually identical fraudulent scheme with the Rubin Investment Group involving the stock of Marx Toys, through which the Rubin Investment Group reaped profits of over $500,000.
"These fraudulent schemes allowed the defendants to receive enormous profits at the expense of innocent investors," stated ROSLYNN R. MAUSKOPF, the United States Attorney for the Eastern District of New York and a member of the President's Corporate Fraud Task Force. "This indictment demonstrates our abiding commitment to prosecuting those who line their own pockets by victimizing the investing public."
PASQUALE J. D'AMURO, Assistant Director-in-Charge of the Federal Bureau of Investigation in New York, stated, "Although the FBI encounters instances of new and innovative white-collar schemes that seek to avoid law enforcement scrutiny, we continue also to see the tried and true mainstays like the pump and dump scheme hatched by these defendants. Undetected, such schemes can generate millions of dollars in illegal profits at the expense of legitimate investors. Our job is to ensure that they do not go undetected for long."
Each defendant is charged with conspiracy to commit securities fraud. In addition, RUBIN is charged with substantive securities fraud counts, mail fraud and conspiracy to commit money laundering, and the remaining defendants are charged with substantive securities counts. The securities fraud conspiracy and substantive securities fraud charges each carry a maximum prison sentence of 25 years and a fine of $250,000, or twice the gain or loss caused by the fraud, whichever is greater. The mail fraud count carries a maximum prison sentence of 20 years and a fine of $250,000, or twice the gain or loss caused by the fraud, whichever is greater. The money laundering count carries a maximum prison sentence of 20 years and a fine of $500,000 or twice the value of the laundered property.
The government is also seeking forfeiture of $3.4 million, representing a portion of the profits from the illegal schemes, as well approximately 3.2 million shares of 1-800-Attorney stock.
