True.

And, it calls for a hearing to differentiate those who will be afforded POW status from those captured who will NOT. (Until the hearing, however, all are presumed to be POWS.)

A legal hearing can be as simple as a military tribunal, held in the field... as the US often did with German terrorists captured in civilian clothes after the end of official hostilities in WW II.
