The Guantánamo detainees have been classified as “unlawful enemy combatants” rather than prisoners of war and are therefore not subject to the Geneva Convention or to US law. The US military has admitted to using coercive interrogation techniques on prisoners but denied that these amount to torture.

The current issue (in my mind) with Gitmo is not torture. These people have been there for 2+ years, and information that they had was probably extracted from them 23 months ago. They certainly aren't getting new information from them last month via torture.

The issue now, since they have no more material information which could be useful to the US, is what to do with them? The US shouldn't hold them indefinitely without charge. If the US can charge them with something, do so. If the US cannot due to lack of proof, let them go. That's how the US system works.
