So holding the conspirators of 9/11 indefinitely at Gitmo is a worse crime than committing 9/11 in the first place? Without an indictment and an evidentiary trial according to the principles of due process, including representation by counsel and the right to confront witnesses and all that legalistic mumbo-jumbo, yes. Because it is America doing it.
