I'm not following you. If you nab someone on a battlefield, tag him and bag him, so to speak, what other evidence do you need? Why do you need a trained jurist to deal with that? Just about anyone can check a tag and see that the paperwork connected with that tag is in order. What witnesses? You have the affidavit of the guys who nabbed him in the paperwork. What torture? Don't need to torture anyone to check his tag.

All of these were afforded the Nuremberg defendants.

The Nuremberg defendants were charged with war crimes. So far as I know, those at Gitmo haven't been charged with crimes, at least most of them haven't. They're simply captured irregular enemy combatants. Saddam is getting a trial. That's appropriate, I think.

If some of those at Gitmo are charged with war crimes, then I would agree with you that the Nuremberg model applies.
