But CB, Hamdi only applies to the "narrow circumstances alleged in this case", ie a US citizen detained on US soil. And even then, the Supremes said that rules of evidence and procedure could be significantly relaxed to accommodate government interest in secrecy and conduct of war.

They were quite plain in saying Hamdi only applied to US citizens, held in the US.
