I'm sure that the founders understood a city could take your house to allow a private pewter shop to be built and the city could derive tax revenue from it. And that's NOT what they had in mind or they would have said so. They knew the difference between a public road and a pewter shop.

And this would hardly be the first time the SCOTUS made a mistake. Remmber Dred Scott? Often listed as a cause of the Civil War. And the SCOTUS could hardly reverse itself fast enough once FDR threatened to pack it in the '30s.
