NOTICE OF APPEAL

PLEASE TAKE NOTICE THAT, pursuant to 28 U.S.C. §§ 1291 and 1292, and Federal Rule of Appellate Procedure 4, Plaintiff, Olivier L. F. Asser, by and for himself, hereby timely APPEALS, to the United States Court of Appeals for the Fifth Circuit, the following, June 2, 2005, Orders of the District Court:

• Dismissal with Prejudice of Plaintiff’s Texas Deceptive Trade Practices Act claims against Defendants Philip R. Berber and Leslie M. Moor;

• Dismissal with Prejudice of Plaintiff’s Racketeer Influenced and Corrupt Organizations Act, Investment Advisers Act of 1940 and Civil Conspiracy claims against all Defendants;

• Declaration that Plaintiff is a vexatious litigant and Injunction; and

• Decree that Plaintiff take nothing in his causes of action against Defendants Philip R. Berber and Leslie M. Moor.
