Two separate issues: Motive and allegation.

In Antitrust law the burden of proof shifts, some would argue significantly, to the defendant, compared to other types of legal proceedings.

Tough to dodge the necessity of "burden of proof" defence against Allegations by shifting the debate to the infinite possibilities of could be "motivation" for making the Allegation.
