If the sole reason for holding them is that they sympathize with Al Qaeda, then how does that differ from imprisonment for political ideology?


They are not there for "sympathies", but for activities.

Amnesty doesn't think that the military tribunal they have had constitutes due process; they want them charged, which can only mean as criminals.
