The rightwing are the ones attacking the Constitution. Separation of church and state. Judges like Janice Brown believe in "God's law" over US law, whatever that means in her personal interpretation. Therefore she could be an activist judge trampling on the Constitution. Exactly what our Founding Fathers warned us to avoid. 75% of Americans polled after the Schiavo case want our judicial system left alone and depoliticized, including the Constitution and separation of church and state. Those agreeing include 50% of evangelicals. In another poll, 40% of evangelicals were found to be moderates or liberals.
