Justice Sandra Day O’Connor’s Retirement Creates an Opportunity for a Return to Traditional Interpretation of U.S. Constitution

(Washington, DC) – Judicial Watch President Tom Fitton issued the following statement with respect to Justice Sandra Day O’Connor’s retirement announcement:

“Justice Sandra Day O’Connor’s pending retirement will create an opportunity for a return to a Supreme Court that is less activist on behalf of liberal values. Whether it be in the areas of abortion, race quotas, or the role of religion in our nation’s public life, Justice O’Connor’s jurisprudence has often been at odds with the plain meaning of the U.S. Constitution, morality and common sense.

“President Bush should keep his campaign promise and nominate an individual in the mold of Justice Thomas or Justice Scalia.

“And the liberal Democrats in the U.S. Senate who have used unconstitutional filibusters to thwart prior judicial nominees should commit to an up or down vote on President Bush’s nominee. Unending debate on a Supreme Court nominee is without precedent and will upend the constitutional order.”
