I can certainly understand in the majority opinion that the USSC doens't want to be involved in property disputes. That's even acknowledged in the dissenting opinion by O'Connor. Thomas wrote a separate dissenting opinion which I've read. I'd only suggest reading that one if you're interested in further exploring the stupidity of Thomas.

Even the opinion by O'Connor goes back and forth and if you picked out certain paragraphs you wouldn't be confident where that opinion was going to end up. She seems to contradict prior precedent more than she clearly states why it's different.

I was truly disappointed in the decision but after reading Hawaii Housing Authority v. Midkiff straylight.law.cornell.edu which was referenced in Kelo, I'm surprised the Kelo decision was as close as it was.
