But a marked pattern of invalidating Congressional laws certainly seems like one reasonable definition of judicial activism.

It can reasonably be argued that refusing to strike down a law that is unconstitutional is not activist (even if it it otherwise negative it is passive not active), but neither is striking down a law that is unconstitutional.

"A marked patter of invalidating congressional laws" might be one measure of activism, but I don't think it can reasonably be considered the primary one.
