The point that you miss is this: The detainees may or may not be entitled to any sort of treatment due to their own status. I am not going there. My point is that they are entitled to certain treatment based on our own laws which govern our own conduct. Torture is against our law. Handing them over to a foreign government for torture is against our law. Our own law requires us to give them humane treatment.
